Introduction of the Terms of Use Agreement:
Our online store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all the legal effects that result from your use of the store’s services through the Internet via this electronic platform. Where the use of any person for the store, whether as a consumer of a service or product of the store or otherwise, is an approval and acceptance from him, and he is in full legal capacity considered legally, systemically, and lawfully for all the articles and provisions of this agreement, and it is a confirmation of your commitment to its systems and what is mentioned in it. This agreement applies to all types of dealings between the consumer and the store. This agreement is effective and enforceable once you approve it and start registering in the store in accordance with Article Ten of the Saudi Electronic Transactions Law.
Article One - Introduction and Definitions:
The above preamble is considered an integral part of this agreement, and below you will find the indications and definitions of the main phrases used in this agreement:
1- (The Store): This definition includes all forms of the store on the Internet, whether it is an electronic application, a website on the Internet, or a commercial shop.
2- (The Consumer): The person who engages in e-commerce in order to obtain the products or services provided by the store through its electronic platform.
3- (The Agreement): This phrase means the terms and conditions of this agreement, which govern and regulate the relationship between the parties to this agreement.
Article Two - Legal Capacity of the Consumer:
1- The consumer acknowledges that he has full legal capacity considered legally and systemically to deal with the store, or that his age is not less than eighteen years.
2- The consumer agrees that in the event of violating this article, he shall bear the consequences of this violation before others.
Article Three - Nature of Commitment:
1- The commitment of the store towards the consumers is to provide (the service or the product).
2- The store may provide other services such as after-sales services or other related services, and this depends on the nature and type of (the service or the product) required by the consumer.
Article Four - Rules of Use:
1- The consumer is committed to using the electronic platform of the store in accordance with public morals and the regulations in force in the Kingdom of Saudi Arabia.
2- The consumer is committed when purchasing a service or product from this store not to use this service or product in violation of public morals and the regulations in force in the Kingdom of Saudi Arabia.
Article Five - Accounts and Registration Obligations:
Once applying for membership in this store as a user, you are committed to disclosing specific information and choosing a username and a secret password to be used when accessing the store’s services. By that, you have agreed to:
1- That you are responsible for maintaining the confidentiality of your account information and the confidentiality of the password, and thus you agree to inform this store immediately of any unauthorized use of your account information with the store or any other breach of your confidential information.
2- The store shall not be, in any case, responsible for any loss that may occur to you directly or indirectly, morally or materially, as a result of disclosing the consumer’s name information or the login password.
3- You commit to using your account or membership in the store by yourself, as you are fully responsible for it, and in the event that someone else uses it, this is a presumption that you have authorized him to use the store in your name and for your account.
4- You commit, when using the store, to use it with seriousness and credibility.
5- You commit to disclosing true, correct, updated, complete, and legal information about yourself as required during registration in the store, and you commit to updating your data in case it changes in reality or when needed.
6- Our store is committed to dealing with your personal information and your contact details with full confidentiality.
7- If it appears to the store that you have disclosed false, incorrect, outdated, incomplete, or illegal information, or information that violates what is stated in the Terms of Use Agreement, the store has the right to suspend, freeze, or cancel your membership or your store and your account on the platform, without prejudice to the store’s other rights and its legitimate means to recover its rights and protect other consumers.
8- In case of non-compliance with any of the above, the store administration has the right to suspend or cancel your store or membership or block you from accessing the store’s services again.
Article Six - Electronic Communications and Official Means of Contact:
1- The parties to this agreement agree that communication takes place via the email registered in the platform.
2- The consumer agrees that all agreements, announcements, statements, and other communications provided electronically shall be considered equivalent to their written counterparts, and they are a valid proof by themselves in meeting statutory and legal requirements.
3- The consumer agrees to the possibility of being contacted and notified of any provisions related to this agreement or dealings with him by the store administration sending general messages addressed to all consumers or specific users of the store.
Article Seven - Amendments to the Terms of Use Agreement and Fees:
1- In the event of cancellation of any article or clause contained in this agreement, or if any article or clause contained in this agreement is no longer valid, such matter does not cancel the validity of the remaining articles, clauses, rules, and provisions contained in this agreement, and they remain effective until further notice from the store administration.
2- This agreement – which may be amended from time to time as required – constitutes the mechanism of work, understanding, and agreement between (the consumer) and (the store).
3- The store may impose fees on some consumers, and this depends on the offers, products, or services they request, or what the state imposes of fees or taxes on the nature of the product or service.
4- The store reserves the right to add, increase, reduce, or deduct any fees or expenses in accordance with the articles, clauses, and provisions of the Terms of Use Agreement, on any of the consumers for any reason of their registration.
Article Eight – Payment and Settlement Services in the Store:
1- The store provides, through its partners, the payment and settlement system in the store, which may be carried out completely online through the payment options available on the store, or through any payment method provided by the store from time to time.
2- The store is committed to setting the price of the service or product offered in its store in accordance with the recognized market value.
3- The store is committed to providing invoices, receipts, and acknowledgments for all amounts and profits arising in its store, and it is committed to giving the consumer an invoice for his purchase of a service or product.
4- The store is committed to providing recognized accounting specifications in its online store, in application of the provisions of this agreement, and for the legal, economic, commercial, and regulatory interests involved.
Article Nine – Intellectual Property:
1- The intellectual property rights of the store are fully owned by the store, whether they were owned before or after the establishment of this electronic platform.
2- The consumer respects the intellectual property rights of the store, including the store’s name itself, the words, logos, and other symbols specific to the store or displayed on it, as every right belonging to the store’s name is fully owned as intellectual property of the store.
Article Ten - Responsibility of the Store:
1- The store is committed to conducting its commercial activity through this electronic platform in a legal manner and in accordance with the regulations in force in the Kingdom of Saudi Arabia and in accordance with the provisions of this agreement.
2- The store shall not bear any claims arising from errors or negligence, whether directly, indirectly, incidentally, by the consumer, or by a third party such as shipping companies.
3- (Store Name), its employees, owners, and representatives are committed that (the product or service) is sound, legal, and authorized in accordance with the laws and regulations of the Kingdom of Saudi Arabia, and that it is used for legitimate purposes.
Article Eleven - Restriction of Access or Membership:
The store may suspend or cancel the consumer’s membership or restrict the consumer’s access to the platform’s services at any time without notice and for any reason, without limitation.
Article Twelve - Applicable Law or System:
This Terms of Use Agreement is governed and drafted in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia, and it is fully subject to the regulations in force with the authorities in the Kingdom of Saudi Arabia.
Article Thirteen - General Provisions:
In the event of cancellation of any article or clause contained in this Terms of Use Agreement, or that any article or clause contained in this Terms of Use Agreement is no longer valid, such matter does not cancel the validity of the remaining articles, clauses, and provisions contained in this Terms of Use Agreement, and they remain effective until further notice from the store administration.
This Terms of Use Agreement – which may be amended from time to time as required – constitutes the Terms of Use Agreement and the mechanism of work, understanding, agreement, and contracting between the store and the consumer. Both parties to this agreement agree to take into consideration the following:
1- The Arabic language is the applicable language when interpreting the provisions of this agreement or when translated into another language.
2- All prices displayed for the store’s services or products may be amended from time to time.
3- Promotional or marketing offers that the store may provide are temporary offers, and the store has the right to amend these promotional or marketing offers at any time or stop them.
4- The parties to this agreement are committed to dealing with each other in a way that does not violate Sharia rules and the regulations and laws in force related to the nature of the dealings between the store and the consumer.
5- This Terms of Use Agreement shall not be canceled except by a decision issued by the store administration.
